Welcome to the Terms & Conditions of DSK Aura / Nicole Smith INT. These Terms apply to all genealogy services, DNA research, chart creation, programs, digital downloads, workbooks, and any products or services offered by us (“Services” and “Digital Materials”).
By using this website, submitting information, purchasing a service, or downloading any materials, you agree to these Terms.
1. Client Information & Responsibilities
You agree that:
All information you provide is accurate, complete, and truthful.
You are responsible for supplying all required genealogical details.
We are not liable for errors due to incomplete or incorrect information.
You will respond promptly if we request further details or clarification.
2. Additional Research & Fees
If essential information is missing, we will notify you. You may either:
Provide the missing details, or
Approve additional paid research.
Research fees are charged per missing ancestor or research gap and must be approved before we proceed.
Note: Genealogical outcomes are not guaranteed due to limits in available historical records.
3. Chart Design, Layout & Production
The starting price includes design and assembly based on the information you provide.
Extra editing, custom design, or restructuring may incur additional charges.
Work only begins once payment is received and information is complete.
Delivery timelines are estimates and may vary.
4. Payment Terms
All Services must be paid in full before work begins.
Payments are non-refundable once work has started (including preliminary research).
Work may be paused if invoices remain unpaid.
5. Proofs & Revisions
You will receive a draft to review.
One round of basic corrections is included.
Additional revisions may incur extra charges, especially if new information is introduced after the draft.
6. Delivery of Final Products
Final charts are delivered digitally unless otherwise arranged.
Printed copies or shipping, if requested, are billed separately.
A service is considered complete once digital delivery has occurred.
7. Privacy, Data Protection & Confidentiality
We handle all genealogical and DNA-related information with strict confidentiality.
Data is used only to deliver your Services.
We do not sell or share your data.
You may request deletion of your data at any time.
8. Intellectual Property
All charts, designs, programs, workbooks, templates, and digital materials created by DSK Aura / Nicole Smith INT remain our intellectual property.
You receive a personal-use licence only. You may not:
copy,
distribute,
share,
publish,
resell, or
modify
any materials without written permission.
9. Digital Products, Programs, Workbooks & Giveaways
This applies to all digital downloads, courses, templates, guides, and free content.
Digital products are for personal use only.
They may not be shared or redistributed.
All digital sales and downloads—paid or free—are non-refundable.
Access to online programs may be updated, changed, or removed as needed.
Results from using educational materials are not guaranteed.
Free resources are provided “as-is” without warranties.
10. Limitation of Liability
To the fullest extent permitted by law:
We are not responsible for indirect or consequential damages.
We do not guarantee genealogical accuracy due to inherent historical limitations.
We are not liable for decisions made based on genealogical or DNA findings.
Our maximum liability is limited to the amount you paid for the specific service or product.
11. Cancellations & Refunds
You may request cancellation before work begins; partial refunds may be granted at our discretion.
Once work has started, no refunds are available.
Research fees, archive access costs, and third-party expenses are non-refundable.
12. Termination of Services
We may terminate a project or program if:
required information is not supplied,
payment is not made,
the Client violates these Terms, or
the Client engages in abusive or inappropriate conduct.
The Client is responsible for payment for all work completed up to the date of termination.
13. Governing Law
These Terms are governed by the laws of United Kingdom.
Any disputes will be handled within the jurisdiction corresponding to the Company’s principal business location.
14. Acceptance of Terms
